  1. SCOPE

The following General Terms and Conditions, in the version valid at the time of the order, shall apply exclusively to the business relationship between Büffel Bill GmbH, Main Street 137, 8274 Tägerwilen and the customer when ordering goods within Switzerland in the online shop on www.bueffelbill.ch.


  1. CONCLUSION

The language available for the conclusion of the contract is German or English. The presentation of the goods on www.bueffelbill.ch does not constitute a legally binding offer from Büffel Bill to conclude a purchase contract, but rather a non-binding online catalog. Only the customer's order of goods constitutes a binding offer from the customer to Büffel Bill GmbH to conclude a purchase contract in Switzerland. The customer submits a binding offer for all items in their shopping cart by clicking the "Confirm Payment" button during the ordering process. Confirmation of receipt of your order, along with acceptance of the order, will be sent via an automated email immediately after submission. This email confirmation constitutes the conclusion of the purchase contract. After receipt of the order, Büffel Bill will inform the customer of the receipt of the order by email, which will contain the details of the order (order confirmation and invoice). Upon receipt of the order confirmation, the purchase contract is simultaneously accepted by Büffel Bill.


  1. RIGHT OF WITHDRAWAL

Right of withdrawal:

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Büffel Bill GmbH, Main Street 137, 8274 Tägerwilen, info@bueffel-bill.ch) by means of a clear statement (e.g. a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.


Consequences of the revocation:

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.


You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.


The right of withdrawal does not apply to the following contracts:

Contracts for the supply of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.Contracts for the supply of goods that can spoil quickly or whose expiration date would be quickly exceeded.

Contracts for the supply of sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been removed after delivery. Model cancellation form

  1. AVAILABILITY OF GOODS

Büffel Bill is entitled to withdraw from the contract if Büffel Bill is not supplied correctly and/or on time by its suppliers. However, there is no right to withdraw if Büffel Bill is responsible for the unavailability of the goods. The customer will be informed immediately of the unavailability of the goods. Any consideration paid by the customer will be refunded immediately.


  1. DELIVERY TERMS

Unless otherwise agreed, delivery will be made to the delivery address specified by the customer.

For fresh products requiring refrigeration, Büffel Bill GmbH only guarantees compliance with the legally prescribed maximum temperatures if the customer selects the "Express Package" shipping method, and even then only if the first delivery attempt of the ordered fresh products to the specified delivery address is successful. Further information on fresh products requiring refrigeration can be found in the Freshness Guarantee. We are also happy to deliver the goods flash-frozen upon request. This is not possible for orders containing mozzarella and burrata.

Büffel Bill is entitled to make partial deliveries as long as this is reasonable for the customer. In the case of partial deliveries, the customer only has to pay the shipping costs that would have been incurred if the entire ordered goods had been delivered.

If present, only the customer himself or an adult authorized by him to accept the delivery is authorized to accept the delivery of the goods. The customer indemnifies Büffel Bill against claims by third parties arising from the violation of this obligation.

If the customer defaults on acceptance or culpably violates other obligations to cooperate, Büffel Bill is entitled to demand compensation for the resulting damage, including any additional expenses. Further claims remain reserved.

The risk of accidental loss or accidental deterioration of the purchased item passes to the customer at the time when the customer is in default of acceptance.

Shipping is via A-Post.

We ship to Switzerland once a week, every Wednesday. For this reason, Thursday can be selected as the desired delivery day.

The delicacies are on the road for less than 24 hours and are delivered to Switzerland between 8 a.m. and 5 p.m.

By making a purchase, the customer agrees to the transfer of necessary data to the relevant shipping service provider.


  1. PRICES, MINIMUM ORDER VALUE, COSTS

The prices valid at the time of order apply. All prices include the applicable statutory VAT.

Exception for public holidays: In the case of public holiday deliveries, there may also be increased delivery costs at a later date.

The minimum order value to Switzerland is 59.90 CHF, the delivery costs are 14.90 CHF.

For orders over 150.00 CHF, delivery to Switzerland is free of charge.

The shipping costs depend on the customer's place of residence, the order quantity and the selected shipping method and will be displayed to the customer during the ordering process.

In the event of cancellation of the contract in accordance with No. 3 of the General Terms and Conditions, the customer is obliged to bear the regular costs of return if the goods delivered correspond to those ordered.


  1. PAYMENT TERMS

The purchase price is due for payment upon conclusion of the purchase contract.

Customers can pay via PayPal, credit card, Klarna, SOFORT Überweisung, and invoice. Further information on the individual payment methods can be found in the payment information.

There is no possibility of a cash discount.

In the event of a direct debit being non-payment or returned, the customer hereby irrevocably authorizes their bank to inform Büffel Bill of their name and current address. Büffel Bill may claim any returned direct debit fees charged to Büffel Bill for reasons attributable to the customer.


PayPal

After confirming the purchase, the customer will automatically be transferred to PayPal to process the payment through the account.


Credit card

Your credit card account will be charged after your order has been completed. Payment will be processed via Shopify Payments.


Klarna

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, the following payment options are offered via Klarna:

Invoice: The payment period is 14 days from the date of shipment. The invoice terms and conditions can be found at Klarna.com/ch.

Pay Immediately: Your account will be charged immediately after the order has been placed.

  1. RESERVATION OF TITLE

The delivered goods remain the property of Büffel Bill GmbH until the purchase price has been paid in full.


  1. WARRANTY

If the ordered goods are defective, the statutory provisions apply. The order is deemed to have been duly fulfilled if the customer does not complain to Büffel Bill GmbH in writing (email) or by telephone IMMEDIATELY after receipt of the goods. Büffel Bill GmbH assumes no liability for loss of quality in unrefrigerated meat deliveries or for delayed acceptance. Büffel Bill GmbH guarantees that the cuts of meat selected for the customer will always correspond to at least the ordered weight at the time of shipment. During delivery, the meat may lose slight weight due to the natural loss of liquid. Büffel Bill GmbH assumes no liability for this and cannot be held liable in the event of a lower weight upon arrival at the buyer's premises. Therefore, no claim for damages, return, or exchange of the delivered products arises.


  1. VOUCHER REDEMPTION

Vouchers issued free of charge by the Seller as part of promotions with a certain period of validity and which cannot be purchased by the Customer can only be redeemed in the Seller's online store and only during the specified period.

Vouchers can only be redeemed by consumers.

Individual products may be excluded from the voucher campaign.

Vouchers can only be redeemed before the order process is completed. Subsequent offsetting is not possible.

Only one voucher can be redeemed per order.

The value of the goods must exceed the amount of the voucher. Any remaining balance will not be refunded by the seller.

If the value of the voucher is not sufficient to cover the order, one of the other payment methods offered by the Seller may be chosen to cover the difference.

The balance of a voucher will not be paid out in cash nor will interest be paid.

The voucher will not be refunded if the customer returns the goods paid for in whole or in part with the voucher within the scope of his statutory right of withdrawal.

The voucher is transferable. The seller can make a payment to the respective holder who redeems the voucher in the seller's online shop with a discharging effect. This does not apply if the seller has knowledge or grossly negligent ignorance of the ineligibility, incapacity or lack of authority to represent the respective holder.

  1. LIABILITY

Buffalo Bill GmbH, Main Street 137, 8274 Tägerwilen, is fully liable for damages caused by intent and gross negligence.

Liability for simple negligence only exists for damages resulting from injury to life, body, or health, as well as for the breach of a material contractual obligation, the fulfillment of which is essential for the proper execution of the contract or the breach of which jeopardizes the achievement of the contractual purpose and on whose compliance the customer regularly relies (cardinal obligation). In the event of a negligent breach of cardinal obligations, liability is limited to damages typical for the contract and foreseeable.

Statutory liability regardless of fault (e.g. under the Product Liability Act) and liability arising from the assumption of a guarantee remain unaffected.

The legal representatives, employees and vicarious agents of Büffel Bill shall not be liable to the extent that Büffel Bill itself.

  1. JURISDICTION AND APPLICABLE LAW

These Terms and Conditions and all related transactions are subject exclusively to Swiss substantive law, excluding the conflict of law provisions of Switzerland and the customer's place of residence.

Subject to any mandatory statutory provisions to the contrary, all disputes arising from these Terms and Conditions shall be subject exclusively to the jurisdiction of Schaffhausen. The Seller, however, reserves the right to also bring proceedings before the competent court at the Customer's place of residence or registered office.

Should one or more provisions be invalid, this shall not affect the validity of the remaining provisions.
